These Staffing Terms (“Terms”) supplement the Terms of Service (www.viralcoach.com/terms) (“Terms of Service”) and govern Viral Coach’s recommendations of potential candidates for roles that support your personal brand or business (e.g., video editors, social‑media managers, virtual assistants). Capitalized terms have the meaning given in the Terms of Service.
1. Viral Coach Staffing Services
Viral Coach may identify and recommend potential candidates to you for the purpose of employment or contracting. Recommendations are provided in an advisory capacity only—you are solely responsible for the selection, hiring, employment relationship and compliance with all applicable employment, tax and business laws. Viral Coach will use reasonable efforts to recommend only qualified candidates based on resumes, portfolios and other benchmarks; however, final selection decisions belong to you.
Once candidate recommendations are provided, you acknowledge that delays in the selection process may impact candidate availability. If you take an extended time to decide, candidates may accept other opportunities and become unavailable. Viral Coach is not liable for missed opportunities due to delays.
2. Staffing Costs
Staffing services are included as part of certain program deliverables but do not include compensation paid to candidates. Candidate compensation and deliverables are entirely between you and the candidate; Viral Coach is not a party to any employment or independent‑contractor agreement. Typical monthly compensation for editing services ranges between $1,000–1,200 USD per month for approximately 30 editing days, or less for fewer editing days, but actual rates depend on experience, market conditions and negotiation. You are responsible for all expenses associated with employing or contracting a candidate.
3. Staffing Satisfaction Guarantee
Viral Coach offers a 30‑day Staffing Satisfaction Guarantee for each candidate hired through our recommendation. If a candidate quits or is terminated within 30 days after onboarding into your organization, Viral Coach will provide one replacement candidate with a new 30‑day guarantee, provided you contact us and complete the recruiting process within two weeks of the first candidate’s departure. Candidate replacements are valid only while you remain an active user of Viral Coach services. If a candidate needs to be replaced and you are no longer an active user, the candidate will be replaced once, but no subsequent replacement guarantee will be available.
The guarantee is contingent on ethical practice, including (a) fair treatment of candidates we recommend; (b) reasonable opportunity for the candidate to learn the job and integrate into your workflow; and (c) completion of the recruiting process within the specified time. If Viral Coach becomes aware of unethical practices impacting recommended candidates, we reserve the right to terminate staffing services and discontinue the guarantee.
4. Non‑Circumvention & Exclusivity
You agree not to circumvent Viral Coach by engaging directly with a candidate recommended by us outside of the program or by hiring the candidate for future work without our prior written consent. You further agree not to solicit or offer employment to Viral Coach staff or contractors during the term of your program and for twelve months thereafter. Violation of this provision constitutes a material breach and may result in liquidated damages equal to 50 % of the annualized compensation offered to the candidate.
5. Limitations of Liability
Viral Coach shall have no liability or responsibility arising from your decision to hire or not hire a recommended candidate, the performance of the candidate, or any claims related to the employer–employee or independent‑contractor relationship. You are solely responsible for compliance with labour laws, tax obligations and business practices.
