Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("Policy") governs the use of the services provided by Viral Coach, LLC ("Viral Coach") to you ("User"). By accessing or using the services, you agree to comply with this Policy, which is designed to ensure that the services are used lawfully, ethically, and responsibly.

Any references to "we," "us," or "our" refer to Viral Coach, and references to "you" and "your" refer to the User. This Policy is incorporated by reference into the terms of service between Viral Coach and the User, and any violation of this Policy may result in suspension or termination of your access to the services.

2. Scope of Use

This Acceptable Use Policy applies to all users ("Users") of the services provided by Viral Coach ("Viral Coach"). The services covered under this policy include, but are not limited to, any software, applications, content, and support provided by the Viral Coach. This policy outlines the acceptable and prohibited uses of the Viral Coach's services to ensure they are used in a legal, ethical, and secure manner.

3. Prohibited Activities

Users must not engage in any activities that:

- Are illegal under applicable law, including but not limited to fraud, copyright infringement, or the sale of illegal goods or services.

- Pose a threat to the security or integrity of any network, system, or data, including activities that distribute viruses, trojan horses, worms, or other malicious software.

- Involve the sending of unsolicited communications, including spam or phishing attacks, to or through the Viral Coach's services.

- Impersonate any person or entity, including the Viral Coach and its employees, or misrepresent an affiliation with any person or entity.

- Involve the publication or sharing of material that is defamatory, obscene, offensive, hateful, or inflammatory.

Constitute harassment, abuse, or harm to another individual or group.

- Interfere with or disrupt the services provided by the Viral Coach or the use of those services by other Users.

Violate the privacy or intellectual property rights of others.

This list of prohibited activities is not exhaustive, and the Viral Coach reserves the right to determine, at its sole discretion, whether an activity constitutes a violation of this Acceptable Use Policy.

4. User Obligations

This Acceptable Use Policy sets forth the obligations of the Users in relation to their use of the services provided by the Viral Coach. By accessing or using the services, Users agree to comply with the following terms:

- Users shall not use the services for any unlawful purposes or in any way that violates any applicable local, state, national, or international law or regulation.

- Users agree not to distribute, upload, make available, or transmit any content that is unlawful, abusive, harmful, threatening, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

- Users shall not impersonate any person or entity, or falsely state or otherwise misrepresent their affiliation with a person or entity.

- Users agree not to engage in any activity that disrupts or interferes with the services, including the servers and networks connected to the services.

- Users shall not attempt to gain unauthorized access to the services, other accounts, computer systems, or networks connected to the services, through hacking, password mining, or any other means.

- Users agree to not use the services to conduct or send unsolicited commercial communication (also known as spam) or collect, store, or use any personal data about other users without their explicit consent.

- Users must ensure that their use of the services complies with all applicable laws and regulations and does not infringe or violate the rights of any third party.

Viral Coach reserves the right to terminate or restrict access to the services for any User who violates these obligations or engages in conduct the Viral Coach deems harmful to its services, other Users, or third parties.

5. Compliance With Laws Against Harassment and Interference with Others (“Targeting”)

Viral Coach is committed to promoting a safe, respectful, and law-abiding online environment. To this end, all Users of Viral Coach’s services are required to strictly adhere to all applicable laws and regulations, including but not limited to, those governing deceptive and misleading advertising, e-mail marketing laws such as the federal CAN-SPAM Act (15 U.S.C. § 7701), telemarketing laws including the federal Telephone Consumer Protection Act (47 U.S.C. § 227) and the Federal Trade Commission’s Telemarketing Sales Rule (16 C.F.R. § 310), laws regarding endorsements and testimonials including the Federal Trade Commission’s Revised Endorsements and Testimonials Guides (16 CFR Part 255), as well as laws related to privacy, security, terrorism, corruption, child protection, and import/export regulations.

Users bear the sole responsibility for ensuring that their conduct, as well as that of any individual accessing Viral Coach’s services through their account, complies at all times with these legal and regulatory obligations. This includes the obligation to be fully informed about and to conform with all laws, rules, regulations, and court orders applicable both within the United States and in any foreign jurisdictions that may apply to the User or their business activities, including any communications sent through or with the assistance of Viral Coach’s services.

In the context of messaging, whether it involves the use of Viral Coach’s messaging software or any third-party messaging systems, software, or hardware, Users agree to comply with all relevant laws pertaining to message sending, including, without limitation, the federal Telephone Consumer Protection Act. Users further agree to indemnify and defend Viral Coach against any claims, damages, losses, or legal actions arising from or related to any alleged or actual illegal or wrongful use of messaging software or hardware by the User, including but not limited to the misuse of any third-party software or platforms such as Facebook, Facebook Messenger, Instagram direct messages (DMs), and internet browser notifications. It is expressly understood that Viral Coach does not guarantee compatibility of its messaging software with any third-party software and cannot be held responsible for the performance or failure of any such third-party software.

6. Enforcement Actions

In the event of any breach of this Acceptable Use Policy by Users, the Viral Coach reserves the right to take any and all enforcement actions deemed appropriate. Such actions may include, but are not limited to:

Issuing warnings to Users;

- Suspending or terminating User access to the services;

- Removing or modifying content that violates this policy;

- Reporting violations to law enforcement authorities as required or deemed appropriate;

- Initiating legal action against Users for violations that cause harm to the Viral Coach or any third parties.

Viral Coach's decision to take enforcement action does not waive its rights to take any other or further actions against breaches of this Acceptable Use Policy.

7. Reporting Violations

If any User becomes aware of any misuse of the services provided by Viral Coach or any violation of this Acceptable Use Policy, including any unauthorized use of the services, the User is encouraged to report such activities to Viral Coach immediately. Reports can be made via email at support@viralcoach.com, or through any other reporting mechanisms that Viral Coach may provide specifically for this purpose.

Upon receiving a report of misuse or violation, Viral Coach will take appropriate action in accordance with its policies and procedures, which may include investigation, suspension, or termination of service, and/or legal action, if necessary. Viral Coach is committed to maintaining the integrity and security of its services and appreciates the cooperation of its Users in upholding these standards.

8. Amendments to the Policy

This Acceptable Use Policy may be amended, altered, or revised by the Viral Coach at any time without prior notice to Users. Users are responsible for regularly reviewing this Policy to ensure they are aware of any changes. The continued use of the services provided by the Viral Coach after any such amendments signifies the User's acceptance of the new terms.

9. Liability Limitation

To the fullest extent permitted by law, the Viral Coach shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Viral Coach has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the services; or (v) any other matter relating to the services.

Nothing in this Acceptable Use Policy shall exclude or limit the Viral Coach's liability for damages which may not be lawfully excluded or limited by applicable law.
